The respective jurisdictions of the state and federal courts will be a major battleground in these cases. Topics include the intersection between insurance company insolvency and chapter 11 practice, how state court insurance rehabilitation proceedings differ from chapter 11 cases, what kinds of business are subject to the state court proceedings -- the scope of 109(b)(2), and when bankruptcy courts will (or should) defer to state court proceedings.
