A debtor’s ability to respond to a overzealous creditor is often a key component for a successful bankruptcy case.  For this Fall’s FLC program, the panel will discuss several recent cases that strengthen and define certain rights and defenses of a debtor against creditors and their claims.  The cases address such topics as allowing a debtor to limit a creditor’s claim in bankruptcy, broadening appellate rights and remedies, and seeking sanctions (including the Supreme Court’s new standard for civil contempt sanctions, which reversed a Ninth Circuit bankruptcy decision).  In addition to providing an overview of the individual cases, the panel will discuss how these issues have been – or may be – decided in the Ninth Circuit.
